| TERMS OF SERVICE

Updated: August 10 2026

This agreement is between myself, NIMN|nimnomin (the “Artist”), and you (the “Client”). The Client is hiring the Artist for a commission hereafter referred to as “commission” and/or “artwork”. Failure to comply with this Terms of Service will result in ban from future commissions, and will result in all rights and ownership to the commissioned artwork rescinded.I, the Artist, am not responsible if the Client fails to read and/or confirm the Terms of Service. The Client bears the responsibility of clarifying with the Artist should there be any policy that they are unsure of.

| GENERAL

• NO DETAILS, NO COMMISSION POLICY:
⤷ Clients are REQUIRED to provide visual references upon request. It is highly discouraged to use and send generative AI as visual references and it may result to instant decline from the artist.
• Do not use my artwork for AI related activities, such as (but not limited to) AI training and generated works;
• Do not use my artwork for any blockchain-related technology i.e NFT or any form of cryptocurrency;
• Do not trace, reproduce any of my artwork;
• Do not edit, modify any of my artwork without my consent;
• Do not claim the artwork as your own creation;
• Reposting the artwork is allowed with proper credit;
• All prices are subject to change.

| COMMISSIONS

• Commissions will be completed within the 4 month window unless discussed otherwise
• The commission slot is reserved and work time starts after payment is settled
• I reserve the right to decline any commission
• Not first come first serve. I arrange my work in consideration to deadlines, complexity and my capacity
• All commissions are delivered digitally
• There will be no progress update and revisions, unless the character is drawn incorrectly, for SKEB commissionCommission work flow and update for client(s) for non-SKEB

⤷ Thumbnailing and rough sketch; major revisions or changes can only be done at this step
⤷ Lining and base coloring; minor revisions are acceptable
⤷ Rendering; not accepting any revisions

3 rounds of free revision, 2 of which are for major revisions and 1 for minor revision
• Major revision example, such as:
⤷ Changing the whole concept, composition, redesigning, pose and outfit, etc.
⤷ Adding of additional character/s and/or props
⤷ Changing of animation planning for animated emotes or GIFtuber commissions
• Minor revision example, such as:
⤷ Changing the hair, skin, eyes base color
⤷ Missed minor details

| PAYMENTS

• For non-skeb services:

⤷ Clients are REQUIRED to pay a minimum of 50% downpayment (non-refundable) or upfront to start the request. Once the draft has been approved by both parties, the client may pay the remaining amount to proceed with the commission.

• For skeb/surprise me services:

⤷ Upfront payment will be made via Paypal invoice; this is non-refundable unless the character is drawn incorrectly.
• Installments or milestone-base payments may be arranged upon mutual agreement, with an agreed down payment required before work is started
• All prices are listed in USD

🍃 PRIVATE COMMISSIONS

• Additional fee of 50% to the total commission cost
• Private commissions process cannot be shown on my stream and social media
• and/or the final artwork will not be displayed on my public portfolios within 14 days* after completion
• and/or final artwork will not be displayed on my public portfolios at any time*If the final artwork can only be shown 15 days or later after completion, you can discuss with me and time the start of your commission to avoid this! Feel free to inquire!

🍃 PROMOTIONAL CONTENT

• Additional fee of 50% to the total commission cost
• This commission fee is required if you intend to use the artwork for profitable digital activities such as, but not limited to: (1) banners, (2) social media promotional posts¹, (3) websites, (4) business cards

🍃 MONETIZED CONTENT

• Additional fee of 100% to the total commission cost
• This commission fee is required if you intend to use the artwork for profitable digital activities such as, but not limited to: (1) youtube and streaming platform thumbnails, (2) music videos

🍃 COMMERCIAL MERCHANDISING

• Additional fee of 200% to the total commission cost
• This commission fee is required if you intend to use the artwork for mass distribution and/or profitable activities, such as, but not limited to: (1) printing the artwork for sale (2) using the artwork for merchandise design/sale

🍃 RUSHED COMMISSION FEE

• Additional fee of 30~50% to the commission cost, depending on the complexity of the request
• Rushed commission fee will be required if the deadline are under 1 week

🍃 OTHER CHARGES

• Complex designs may increase the commission cost
• Additional charges will be applied for designing work*
*Designing work such as character, mascot and outfit without any references.

Commission type - emotes, badges, panels, png- and gif-tubers are by default allowed to be used for their respective purposes on monetized channels. However, the use of these artworks for further profitable activities will require Commercial Rights

| REFUND & CANCELLATION

The Client must never request/submit a chargeback under any circumstances. This will be considered a violation of my Terms of Service. If a refund has been agreed on, I will transfer the funds to you per our agreement, platform fees will not be refunded.Refund/cancellation can only be done under these circumstances, such as:

⤷ I, the Artist, will cancel the commission and/or unable to finish the commission
⤷ Work for the commission have not started within 3 month of the payment completion
⤷ Delayed caused of Client can lead into cancellation if there’s no transparent reason

For cancellation mid-commission requested by the Client, a partial refund may be available but not guaranteed. In this instance:

⤷ the Artist will discuss with the Client with consideration to work done and workflow of said commission
⤷ I, the Artist, maintain the right to reuse/modify/adopt the work in progress for another design/artwork/commission.
⤷ Naturally, I will not directly reuse any concepts unique to the previous Client, but will modify/adopt them appropriately.

| USAGE RIGHTS

• I, the Artist, own the intellectual property rights & copyrights to the artwork and any original designs. The intellectual property rights of the existing character drawn belong to their respective owners.
• Commissioned artwork are for personal use only unless discussed otherwise
• I, the Artist, have the rights to stream my work progress and showcase the final work on Twitch and/or social media platform/s
